Personal data is processed for the following purposes:
operating, maintaining, and improving the PLUSH74 platform,
reviewing and managing Member applications and profiles,
handling location requests and bookings,
facilitating communication between Clients and Members,
providing concierge, scouting, management, and consulting services,
invoicing, payment processing, and accounting,
customer support and platform communication,
compliance with legal and regulatory obligations,
safeguarding the security and integrity of the platform.
PLUSH74 processes personal data based on one or more of the following legal bases:
performance of a contract or pre-contractual measures,
legitimate interests of PLUSH74 (e.g. platform operation, security, fraud prevention),
consent, where explicitly obtained,
legal obligations under Swiss or applicable foreign law.
Where GDPR applies, Art. 6 GDPR serves as the corresponding legal basis.
PLUSH74 may disclose personal data to third parties only where necessary and permitted by law, including:
Members and Clients (to enable bookings and communication),
service providers acting as processors (e.g. hosting, IT, CRM),
payment service providers (e.g. Stripe, banks),
accounting, legal, and tax advisors,
affiliated companies within the PLUSH74 group (in particular Plush74 Germany GmbH).
All processors are contractually bound to process data only in accordance with PLUSH74’s instructions and applicable law.
Personal data may be transferred to recipients outside Switzerland or the EU/EEA where required for platform operation (e.g. cloud services, payment providers).
Such transfers take place only where:

15.1 Scope of Application
This section applies to communications sent to PLUSH74, including but not limited to emails addressed to:

15.2 Purpose of Processing
PLUSH74 uses automated systems, including AI-based technologies, to process incoming communications for the following purposes:
Categorization and routing of location requests
Extraction of relevant booking and contact information
Assistance in responding to inquiries
Facilitation of communication between Members and Clients
Internal workflow optimization and platform operation
Such processing is necessary to efficiently provide and operate the services offered via www.staging.plush74.com.
15.3 Categories of Data Processed
Depending on the content of the communication, the following categories of personal data may be processed:

Email address
Company name
Phone number (if provided)
Content of the email communication
Attachments voluntarily submitted
Technical metadata (e.g., timestamps, server logs)
PLUSH74 processes only data that is necessary for the stated purposes.
15.4 Legal Basis
Processing is carried out on the basis of:
Art. 6(1)(b) GDPR – performance of a contract or pre-contractual measures initiated by the data subject
Art. 6(1)(f) GDPR – legitimate interest in operating a secure, scalable, and efficient communication infrastructure
Where Swiss data protection law applies, processing is carried out in accordance with the revised Swiss Federal Act on Data Protection (revFADP).
15.5 No Automated Decision-Making under Art. 22 GDPR
PLUSH74 does not carry out fully automated decision-making within the meaning of Art. 22 GDPR that produces legal effects or similarly significant effects for data subjects.
Automated systems support internal processing. Final contractual decisions, approvals, rejections, or booking confirmations are not made solely by automated means.
15.6 Use of Service Providers (AI Processing)
PLUSH74 uses technical service providers to support email processing and platform operation.
This may include:
Hosting providers located in Germany
AI technology providers for automated text processing
Where AI-based services are used, processing may be performed by OpenAI, L.L.C. or affiliated entities under a data processing agreement pursuant to Art. 28 GDPR.
PLUSH74 has disabled any use of submitted data for AI model training where technically available.
Where personal data is transferred to countries outside the European Union or Switzerland, such transfers are based on appropriate safeguards, including Standard Contractual Clauses in accordance with Art. 46 GDPR.
15.7 Data Retention
Email communications and associated processing data are stored only for as long as necessary to:
Fulfil contractual obligations
Handle inquiries and bookings
Comply with statutory retention requirements
Defend against legal claims
Data that is no longer required will be deleted or anonymized in accordance with applicable law.
